Introduction

Gigaly, Inc. (“us”, “we”, “our”, “Service” or “Gigaly”) values your privacy and is committed to respecting the privacy rights of our users. This Privacy Policy describes the information that we collect, how we use and may share it, and how you can modify or delete your own data. The use of our Service is governed by our Terms of Service and this Privacy Policy. When you use our Service, you agree to our Privacy Policy and Terms of Service. You may translate this Privacy Policy into other languages; however, the English version governs your relationship with Gigaly.

Interpretation and Definitions

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

  • Account means a unique account created for You to access our Platform or parts of our Platform.

  • Device means any device that can access the Platform such as a computer, a cellphone or a digital tablet.

  • Gigaly Content refers to all content which Gigaly makes available through our platform

  • Personal Data is any information that relates to an identified or identifiable individual.

  • Platform or Service refers to our mobile applications, website and our web applications

  • Third-party Authentication Service refers to any website or any social network website through which a User can create an Account on the Platform, and use it to authenticate to our Platform and use the Service.

  • Service Provider or Pro refers to an individual or an entity who completes our registration process for our services in order to receive information about projects and quote requests, post promotions of their services and bid on projects.

  • User refers to a member who has signed up to request and receive quotes and bids from our service providers

  • User Content refers to any content posted on the platform by either a User or a Pro 

  • Usage Data refers to data collected automatically, either generated by the use of the Platform or from the Platform infrastructure itself (for example, the duration of a page visit).

Collecting and Usage of Data

We collect different types of data depending on how you use Our Platform and the type of Service you receive from us. The data collected comes in two forms; the data that you provide to us directly and the data that we collect automatically by using our Platform and Service.

Information you provide directly to Us

We may collect information about you when and during the use of our Platform which includes but is not limited to:

  • When you sign up for an Account as a User

  • When you register as a Service Provider

  • When you as a User create a project and request quotes from Service Providers

  • When you submit a response to a quote

  • When you use our in-app chat

  • When you create or use a promotion

  • When you as a Service Provider bid on a project

  • When any User Content is posted on our platform

  • When you communicate with us through email, phone, our platform or any other means

This information may include but is not limited to:

  • First name, last name, email address, address, phone number

  • Business name and address, phone number, date of birth, business registration, insurance information, identity verification, payment information, service description, qualifications, photographs

  • Information from Third-party Authentication Services such as but not limited to: Apple, Facebook and Google if you use them for account creation.

  • Information about your project, its location and photographs pertaining to your projects.

  • Information regarding your location while using the Platform in order to find Service Providers and promotions near you.

Information Collected Automatically

When you use our Platform, we automatically collect certain information by the interaction of your Device with our platform.

We may use cookies, web beacons, behavioral advertising or similar technologies to track the use of our Platform. We may also record information when you use Our Platform, including the URL, IP address, browser type, language, and the date and time of your usage. Gigaly uses this information to analyze trends among its users to help improve its platform or customize and curate the content that you receive from us.

Use of Information Collected

We use the information collected from our Users and Service Providers to the extent necessary to provide Our Service, and according to all applicable laws and regulations. We may use the information in the following situations:

  • To provide and maintain our Service and monitor our Service usage

  • To manage and secure your account: your registration as a User can give you access to our Platform and the functionalities of our Service, which are only available to registered Users

  • To list you as a Service Provider on the Platform so that you can receive quote requests, bid on projects, and post promotions

  • To receive updates about projects, services and promotions

  • To resolve complaints and disputes

  • For other purposes such as data analysis, identifying usage trends, determining the effectiveness of promotions and to evaluate and better our Platform and Service

We may share your personal information in the following situations:

  • ID Verification: for ID verification of our Service Providers, we use Persona. Persona is a global leader in ID and document verification based out of the United States of America and with operations in Canada. Their privacy policy is posted at: https://withpersona.com/legal/privacy-policy

  • Billing and Payment: billing and payment for our Service Providers are carried out by Stripe. Stripe is a global leader in payment and financial services. Their privacy policy is posted at: https://stripe.com/en-ca/privacy

Data Retention

We will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.

Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.

The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.

 

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Security of Your Personal Data

The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security

 

Sharing User Phone Numbers with Service Providers

  • Phone Number Sharing. When you choose to voluntarily provide your phone number on our platform, it will only be shared with the service providers you select. We do not share your phone number with any third parties or service providers unless you explicitly authorize us to do so. 

  • Limited Use. Your phone number is exclusively used for the purpose of connecting you with the specific service providers you have chosen. We do not use your phone number for any other purposes, such as marketing, promotions, or data analysis. 

  • No Access to Text Messages. We want to emphasize that Gigaly does not have access to the content of your text messages or any other personal data contained within them. Our platform solely facilitates communication between you and the chosen service providers, and we do not intercept or access the content of your messages. 

  • Data Security. We take the security of your personal information seriously. We employ industry-standard measures to protect your phone number and ensure its confidentiality. However, it is important to note that while we take all reasonable precautions, no data transmission over the internet can be guaranteed to be completely secure. 

  • Your Consent Matters. Your consent is essential to us. By voluntarily providing your phone number on our platform, you explicitly authorize us to share it with the selected service providers for the purpose of facilitating communication between you and them. If you have any concerns or questions about how your phone number is handled or if you wish to revoke your consent, please contact us at support@gigaly.com. By using our platform and voluntarily providing your phone number, you agree to the terms outlined in this section of our Privacy Policy.

Deletion of Account and Personal Data

You have full control over your own data, and therefore you can delete your account with all your data at anytime. You can request your account to be deleted via the app by going to Settings and requesting Deletion or by contacting our support team. Account and data deletions are performed within 30 days of request.

Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.

If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require Your parent's consent before We collect and use that information.


Links to Other Websites

Our Service may contain links to other websites that are not operated by Us. If You click on a third party link, You will be directed to that third party's site. We strongly advise You to review the Privacy Policy of every site You visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.
